Case Balance Timetable


At a hearing on October 29, 2003, the Federal Magistrate set the following timelines:
  1. AT&T to send us the class list this week.
  2. AT&T to provide us with depositions of AT&T consultants from another lawsuit that may have relevant information.
  3. We are to issue a subpoena to AT&T's mailer, Universal Mailing, to obtain information about who received the 1998 SUMMARY PLAN DESCRIPTION.
  4. We have provided our actuary's and communications expert's reports to AT&T. AT&T is to provide us with theirs. Their actuarial report is due December 15.and their communication report is due January 31, 2004.
  5. All Expert depositions are to be complete by the second week in Feb.
  6. All Motions must be completed by April.

This takes us to the Summer timeframe. Our Attorney, Stephen Bruce, believes that Summary Judgment may be rendered without a trial. The presiding Judge may decide the case on Summary Judgment after he reviews all the information that has been submitted by both sides. There is no time limit on when to expect the Judge's opinion. The tide is turning on Cash Balance Plans so time is on our side.
